Psychology in Mediation: Applying Cialdini, Fisher, and Shapiro

As part of our quarterly “Lunch and Learn” series, we invite IAM members as well as non-members to join an hour-long presentation entitled “Psychology in Mediation: Applying Cialdini, Fisher, and Shapiro” on Thursday, May 23, 2024 at 12 pm EST / 11 am CST via ZOOM. This event will be presented by Stephen L. Shields, JD LLM, Founder and Principal of the Alternative Dispute Resolution Institute.

The field of social psychology offers mediators valuable insights into how they can influence parties’ perceptions of conflict and their choices for reaching a settlement, in both ordinary and challenging mediation scenarios. Robert Cialdini (Influence: The Psychology of Persuasion) has identified six components of influence, all of which can be useful for mediators. Fisher & Shapiro (Beyond Reason: Using Emotions to Negotiate) have identified five core emotional needs or concerns that if affirmatively addressed during mediation should stimulate positive, helpful emotions. The focus of Mr. Shield’s presentation will be on the application of Cialdini’s and Fisher & Shapiro’s principles as well as discussing other psychological insights regarding overcoming or minimizing the parties’ subconscious biases.

Stephen L. Shields, JD, LLM

Stephen L. Shields, JD, LLM is the founding member of Alternative Dispute Resolution Institute and a Partner in the Memphis law firm of Jackson, Shields, Yeiser, Holt, Owen & Bryant. He is a Tennessee Supreme Court Alternative Dispute Resolution Rule 31 Listed General Civil Mediator as well as Rule 31 General Civil Mediation Trainer. Mr. Shields was a past Commissioner on the Alternative Dispute Resolution Commission from January 2018 to January 9, 2024, and was its Chair from January 2022 to January 8, 2024. He is a Listed Mediator in the Mediator Profile Directory of the United States District Court Western District of Tennessee. Mr. Shields is a frequent speaker and author regarding alternative dispute resolution topics. He is also a founding member and Past-Chair of the Mid-South Community Justice and Mediation Center (CJAM). He is the Past-Chair of the Tennessee Bar Association Alternative Dispute Resolution Executive Council as well as Past-Chair of the Memphis Bar Association Alternative Dispute Resolution Section and Past-President of the Tennessee Association of Professional Mediators. In 2015, Mr. Shields was chosen as the recipient of the Grayfred Gray Public Service in Mediation Award. He is an adjunct professor at the Cecil C. Humphreys School of Law at the University of Memphis where he is the Director of the Mediation Clinic. He has been listed in Best Lawyers since 1991.
